These Terms of Service (“Terms”) govern your use of bookednbanked.com (the “Site”) and the coaching, consulting, and digital products offered by Booked ‘n’ Banked (“Booked ‘n’ Banked,” “we,” “us,” or “our”), including Corey On Call, our AI STR coach, when available (together, the “Services”). By using the Site or buying or using the Services, you agree to these Terms. If you don’t agree, don’t use the Site or Services.
1. Who can use the Services
You must be at least 18 years old and able to enter into a binding contract. If you use the Services on behalf of a business, you confirm you are authorized to bind that business to these Terms.
2. Our Services
Booked ‘n’ Banked provides short-term rental (STR) education, coaching, and consulting, including our STR Start-to-Finish coaching program, listing setup, pricing consultations, messaging system setup, business license procurement assistance, and product sourcing guides. The scope, deliverables, schedule, and price of a specific engagement are described on the Site or in a written proposal or agreement. If a written agreement conflicts with these Terms, the written agreement controls.
3. Education only, not professional advice
Our Services, content, and Corey On Call are for general educational and informational purposes. Booked ‘n’ Banked is not a law firm, accounting firm, financial advisor, lender, insurance agency, or licensed real estate brokerage. Nothing we provide is legal, tax, financial, investment, insurance, or real estate brokerage advice, and we do not represent you in any real estate transaction. Before you buy property, sign contracts, apply for permits, or make financial decisions, consult qualified licensed professionals. Short-term rental laws, zoning, taxes, and HOA rules vary by location and change often; you are responsible for confirming and complying with the rules that apply to your property.
4. No guarantee of results
Short-term rental performance depends on many factors outside our control, including your market, property, pricing, reviews, platform policies, regulations, and how you run your business. We do not guarantee any level of bookings, occupancy, revenue, profit, or return on investment. Testimonials and examples on the Site reflect individual experiences and are not typical or guaranteed results.
5. Your responsibilities
- Give us accurate information and the access we need to perform the Services (for example, to your listing or pricing tools, where you choose to share it).
- Make your own decisions. You are solely responsible for your property, investments, guest relationships, and business operations.
- Keep any account credentials you share with us secure, and change them when an engagement ends.
- Don’t misuse the Site or Services, including by interfering with their operation, attempting unauthorized access, or using them for unlawful purposes.
6. Payments
Prices are listed in U.S. dollars on the Site or in your proposal and may change at any time before you buy. Payments are processed by our third-party payment provider, and you authorize us and that provider to charge your selected payment method. You are responsible for any applicable taxes.
7. Scheduling, cancellations, and refunds
- Sessions and consultations: you may reschedule a scheduled session with at least 24 hours’ notice. Sessions missed without notice may be forfeited.
- Done-for-you services (such as listing setup, messaging setup, and license procurement): once work has begun, fees are non-refundable, except as required by law or agreed in writing.
- Digital products (such as the Product Sourcing Guide): because they are delivered immediately, all sales are final once delivered.
- Government and third-party fees (such as license filing fees or software subscriptions) are your responsibility and are not refundable by us.
If you believe you were charged in error, contact us within 30 days of the charge.
8. Corey On Call (AI STR Coach)
Corey On Call is an AI coach trained on the knowledge, methods, and proven short-term rental expertise of Booked ‘n’ Banked founder Corey D’Agostino, including the strategies and checklists he uses with coaching clients. It uses artificial intelligence to generate answers. It is not Corey himself or a human coach, and its answers may be incomplete, outdated, or wrong. Verify important information before relying on it, and don’t treat its answers as professional advice. We may set usage limits, change features, or offer free and paid access levels, and we may suspend access for misuse. Paid access, if offered, will be described at the time of purchase.
9. Intellectual property
The Site, the Booked ‘n’ Banked name and logo, and all content, guides, templates, checklists, vendor lists, and materials we provide are owned by Booked ‘n’ Banked or its licensors and are protected by law. When you buy or receive materials, we grant you a limited, non-exclusive, non-transferable license to use them for your own short-term rental business. You may not resell, republish, share publicly, or create competing products from our materials without our written permission.
10. Confidentiality
We treat the non-public information you share about your property and business as confidential and use it only to provide the Services, except as described in our Privacy Policy or required by law.
11. Third-party services and vendors
We may recommend or connect you with third-party vendors, platforms, and tools (for example, cleaners, contractors, photographers, agents, PriceLabs, or Hospitable). We don’t control and aren’t responsible for their products, services, pricing, or conduct. Your dealings with them are solely between you and them.
12. Disclaimer of warranties
The Site and Services are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
13. Limitation of liability
To the fullest extent permitted by law, Booked ‘n’ Banked and its owners, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, bookings, or data, arising from or related to the Site or Services. Our total liability for any claim related to the Site or Services is limited to the amount you paid us for the Service giving rise to the claim in the 12 months before the claim arose.
14. Indemnification
You agree to defend, indemnify, and hold harmless Booked ‘n’ Banked and its owners and contractors from claims, losses, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your property or business operations, or your violation of these Terms or the law.
15. Governing law and disputes
These Terms are governed by the laws of the State of North Carolina, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us and try to resolve the dispute informally for at least 30 days. Any claim that is not resolved informally will be brought exclusively in the state or federal courts located in North Carolina, and you consent to their jurisdiction.
16. Changes and termination
We may update these Terms from time to time by posting the new version on this page and changing the effective date. Continued use of the Site or Services after changes means you accept them. We may suspend or end your access to the Site or Services if you violate these Terms.
17. General
If any part of these Terms is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. These Terms, together with any written agreement for a specific engagement and our Privacy Policy, are the entire agreement between you and us about the Site and Services.
